Section A: General Terms for Realms to Riches Website & Services
Welcome to Realms to Riches. This section governs your use of the Realms to Riches website (the "Site") and the purchase of general one-time services (e.g., Brand Kits, Consultations).
1. Acceptance of Terms
By accessing the Site or making purchases, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, please do not use the Site.
2. Intellectual Property
All content on the Site, excluding third-party assets and user-submitted data, is the property of Realms to Riches and protected by copyright law. This includes text, graphics, logos, and course materials.
3. Payments, Refunds, and Cancellations for General Services
Policies for one-time services like consultations and brand kits are as follows:
- Refunds: Refunds for one-time services may be considered on a case-by-case basis within 7 days of purchase, provided no significant work has commenced or deliverables have been provided. After 7 days, or once work has begun, payments are generally non-refundable.
- Cancellations: If you wish to cancel a one-time service before work has commenced, a cancellation fee may apply.
4. Affiliate Disclaimer
The Site contains affiliate links. When you click on these links and make a purchase, we may receive a commission at no extra cost to you. We are not responsible for the content, products, or practices of any third-party websites.
Section B: Specific Terms for JARVIS 3.5 AIaaS Platform
This section governs your access to and use of the JARVIS 3.5 AI-as-a-Service platform (the "Service"). By subscribing to any Jarvis 3.5 tier, you agree to these specific terms in addition to the general terms in Section A and C.
1. Service Description
JARVIS 3.5 ("the Company," "we," "us") provides an enterprise-level AIaaS platform that allows businesses ("Customer," "you") to leverage artificial intelligence models via API calls and a software interface, offered in various subscription tiers.
2. Accounts and Registration
To access the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Fees and Payment for JARVIS 3.5
- Service Tiers: The Service is available under various tiers ("BASIC," "Custom," "Gang of Symbiotic AI Managers"). Fees are specified at the time of purchase via our Stripe-powered pricing page.
- One-Time Charges: Each plan requires a non-refundable, one-time setup charge ("One-Time Charge") which is due upon execution of your subscription. This fee covers initial onboarding, setup, and software licensing.
- Monthly Subscription Fee: A recurring monthly fee is charged in advance for access to the platform and includes a specified monthly quota of API calls ("Included API Calls").
- Usage-Based Fees:
- Data Consumption: You will be billed for all data processed by the Service ("Data Consumption") on a per-gigabyte (GB) basis, at the rate determined by your selected tier.
- API Call Overage: Any API calls made in a billing period that exceed your tier's "Included API Calls" will be billed as an overage ("API Overage") per 1,000 calls, at the rate for your selected tier.
- Payment Processing: All payments are processed through our third-party payment processor, Stripe. By using the Service, you agree to Stripe's terms of service. You authorize us and Stripe to charge your selected payment method for all applicable fees.
- Invoicing: At the end of each monthly billing cycle, you will be automatically invoiced for: (a) the next month's recurring subscription fee, and (b) any usage-based fees (Data Consumption and API Overage) incurred during the prior month.
4. Customer Data and Intellectual Property
- Your Data: You retain all ownership rights to the data you submit to the Service ("Customer Data"). You grant us a worldwide, non-exclusive, royalty-free license to use, process, and transmit Customer Data solely as necessary to provide and improve the Service.
- Our Intellectual Property: We retain all rights, title, and interest in and to the Service, including all underlying software, AI models, algorithms, and documentation.
5. Term and Termination for JARVIS 3.5
This agreement begins on the date you subscribe and continues on a month-to-month basis. You may terminate your subscription at any time through your Stripe customer portal. We reserve the right to suspend or terminate your access for any breach of these Terms, including non-payment of fees.
Section C: General Legal Provisions (Applies to All Users and Services)
1. Disclaimer of Warranties
THE SITE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
2. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REALMS TO RICHES, ITS OFFICERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, RESULTING FROM YOUR USE OF THE SITE OR SERVICES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US IN THE 6 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
3. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, United States, without regard to its conflict of law principles.
